Legal status of CBD and Delta-8

Under the federal 2018 Farm Bill, all hemp-derived cannabinoids including all Delta-8 THC derived from hemp, fall within the definition of hemp, which is no longer a controlled substance federally and can be legally produced and sold, subject to a complex set of federal regulations. However, the laws are changing all of the time so it’s better to check your state laws and stay informed through the Hemp Round Table.

Products approved by FDA

Four products that have been approved by FDA are as follows

Epidiolex

It contains a purified form of the drug substance CBD for the treatment of seizures associated with Lennox-Gastaut syndrome or Dravet syndrome in patients 1 years of age and older. It has also approved Epidiolex for the treatment of seizures associated with tuberous sclerosis complex in 1 year or older. That means FDA has concluded that this particular drug product is safe and effective for its intended use.

Cesamet

It contains the active ingredients nabilone, which has a chemical structure similar to THC and is synthetically derived. It helps with nausea and neuropathic pain. It may interact with amphetamines, medicine to treat attention deficit hyperactivity disorder (ADHD). It is not recommended for use during pregnancy because of possible fetus/infant harm reported with marijuana exposure.

Marinol and Syndros

The agency has approved both for therapeutic uses in the United States, including for the treatment of anorexia associated with weight loss in AIDs patients. Both help in nausea from cancer chemotherapy.

Furthermore

The agency has and will continue to monitor the marketplace and take action as needed to protect the public health against companies illegally selling cannabis and cannabis-derived products that can put consumers at risk and that are being marketed for therapeutic uses for which they are not approved. At the same time, FDA recognizes the potential therapeutic opportunities that cannabis or cannabis-derived compounds could offer and acknowledges the significant interest in these possibilities. FDA continues to believe that the drug approval process represents the best way to help ensure that safe and effective new medicines, including any drugs derived from cannabis are available to patients in need of appropriate medical therapy.
